These General Terms and Conditions ("Terms") govern the relationship between you ("Customer" or "you") and HyperAI in relation to the use of our Cloud GPU service.

By using our services, you agree to these Terms. If you do not agree, please do not use our services.

• Services
  1. HyperAI provides a cloud-based GPU service. We offer you access to and use of the Services on a subscription basis.
• Customer Obligations
  • You are responsible for all activity that occurs in your user account. You shall not share access to your account with any other person.
  • You agree to use the Services in compliance with all applicable laws and regulations.
• Payment and Renewal
  • Fees for the Services are due in advance and are non-refundable, unless otherwise stated in these Terms or as required by Dutch law.
• Intellectual Property
  • HyperAI retains all right, title, and interest in the Services. These Terms do not grant you any intellectual property rights in the Services.
• Data Protection and Privacy
  • Our Privacy Policy, which is incorporated by reference into these Terms, explains how we collect and use your personal data and protect your privacy when you use the Services.
• Limitation of Liability
  • To the maximum extent permitted by Dutch law, HyperAI will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
• Indemnity
  • You agree to indemnify and hold HyperAI harmless from any claim or demand made by any third party due to or arising out of your breach of these Terms, your violation of any law, or your violation of the rights of a third party through your use of the Services.
• Changes to Terms
  • We may revise these Terms from time to time. If we make a change that we believe substantially reduces your rights, we will notify you.
• Governing Law
  • These Terms are governed by Dutch law, without regard to its conflicts of laws principles. You agree to the exclusive jurisdiction of the courts in Amsterdam, The Netherlands.
